Terms of Use

These Terms of Use ("Terms") are a legal agreement between you ("you") and bitrotlab ("bitrotlab", "we", "us" or "our"), made by the makers of FileGriffon, governing your use of the bitrotlab website at bitrotlab.com and everything on it (together, the "Site").
By ticking "I have read and agree" before using your own files on the Site, or by otherwise using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
1. What the Site is
bitrotlab is an educational lab about file corruption. Its pages show, with examples you can try, how files get damaged and how parity data can repair them.
The Site is not a repair, recovery or backup service. It cannot repair, recover or improve your files, and nothing on it is professional advice about your data, your storage or your backups. If you have a damaged file that matters to you, stop using the storage it is on and start with a backup or a data-recovery professional.
Results shown on the Site are illustrative. They are real calculations, but how a damaged file looks or behaves depends on your browser and device, and a simplified example cannot predict what happens to any particular real file.
2. Eligibility
The Site is intended for a general audience. If you are under the age of majority where you live, you may use the Site only with the permission of a parent or guardian.
3. Your files stay on your device
When you use your own picture or file on the Site, it is read and processed entirely inside your browser on your device. It is not uploaded to us or to anyone else, and we never receive it, its name, its size or its contents. Closing or reloading the page discards it.
You are solely responsible for the files you choose to use. Only use files you have the right to use, and do not use files you are not permitted to process, such as other people's private material without their permission.
Copies of files that the Site damages on purpose are saved only if you choose to save them. A damaged copy can behave unpredictably when opened by other programs: it may fail to open, display incorrectly or, rarely, make a program crash or stop responding. Never replace an original with a damaged copy, never open a damaged copy of a program or script, and keep damaged copies away from anything important.
4. Acceptable use
You will not: (a) attempt to disrupt, overload, damage or impair the Site or the services it runs on; (b) attempt to gain access to any part of the Site or its infrastructure that is not publicly offered; (c) use the Site for any unlawful purpose or to harm others; or (d) use automated means to copy the Site or its content wholesale.
Linking to the Site, and quoting short passages with credit, is welcome.
5. Intellectual property
The Site and all of its text, graphics, illustrations, code and design are owned by bitrotlab. All rights reserved. You may view and use the Site for your own personal, non-commercial learning. You may not copy, republish, redistribute, modify or reuse its content or code, in whole or in substantial part, without our prior written permission.
"bitrotlab" and "FileGriffon" are our names. Nothing in these Terms grants you any right to use them.
Some components of the Site are made by others and are used under their own licences, for example the IBM Plex typefaces (SIL Open Font License). Those licences govern those components.
6. No warranty
THE SITE IS PROVIDED FREE OF CHARGE, "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY AND NON-INFRINGEMENT. BITROTLAB DOES NOT WARRANT THAT THE SITE WILL BE AVAILABLE, UNINTERRUPTED, SECURE OR ERROR-FREE; THAT ANY DEFECTS WILL BE CORRECTED; THAT THE SITE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR THAT ITS EXPLANATIONS AND RESULTS ARE COMPLETE OR ACCURATE FOR ANY PARTICULAR FILE. NO ADVICE OR INFORMATION OBTAINED FROM THE SITE CREATES ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
7. Assumption of risk
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE SITE IS AT YOUR SOLE RISK. You are responsible for which files you use on the Site, for anything you save from it, and for what you do with saved copies, including opening them with other programs.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
8.1 EXCLUSION OF DAMAGES. IN NO EVENT WILL BITROTLAB, ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR ANY LOSS OF OR DAMAGE TO DATA, FILES, DEVICES OR SOFTWARE, OR ANY LOSS OF PROFITS, REVENUE, GOODWILL OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF (OR INABILITY TO USE) THE SITE, OR ANY COPY OF A FILE SAVED FROM IT, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE) AND EVEN IF BITROTLAB HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
8.2 CAP. BITROTLAB'S TOTAL AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE, WHETHER IN CONTRACT, TORT OR OTHERWISE, WILL NOT EXCEED FIFTY US DOLLARS (USD 50).
8.3 BASIS OF THE BARGAIN. YOU ACKNOWLEDGE THAT THE SITE IS PROVIDED FREE OF CHARGE, THAT THIS ALLOCATION OF RISK IS AN ESSENTIAL BASIS OF THESE TERMS, AND THAT WITHOUT IT BITROTLAB WOULD NOT BE ABLE TO PROVIDE THE SITE.
8.4 INDEPENDENT LIMITATIONS. EACH PROVISION OF THESE TERMS THAT LIMITS LIABILITY, DISCLAIMS WARRANTIES OR EXCLUDES DAMAGES IS SEVERABLE AND INDEPENDENT OF ANY OTHER PROVISION, AND REMAINS IN FULL EFFECT TO THE MAXIMUM EXTENT PERMITTED BY LAW.
Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, the above limitations apply only to the extent permitted by law (see Section 9).
9. Consumer rights carve-out
NOTHING IN THESE TERMS EXCLUDES, RESTRICTS OR MODIFIES ANY RIGHT OR REMEDY, OR ANY GUARANTEE, WARRANTY OR OTHER TERM OR CONDITION, IMPLIED OR IMPOSED BY APPLICABLE LAW (INCLUDING CONSUMER-PROTECTION LAW) THAT CANNOT LAWFULLY BE EXCLUDED, RESTRICTED OR MODIFIED. Where such law applies and prohibits the limitations in Sections 6, 8 or elsewhere in these Terms, those limitations apply only to the maximum extent such law permits.
10. Indemnification by you
You agree to defend, indemnify and hold harmless bitrotlab and its owners, officers, employees, contractors and agents from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use or misuse of the Site; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual-property or privacy rights, in connection with files you choose to use on the Site; or (d) your violation of any applicable law in connection with your use of the Site.
11. Links to other websites
The Site links to other websites, including filegriffon.com and the sources it cites. We do not control those websites and are not responsible for their content or practices; their own terms and policies apply.
12. Privacy
How the Site handles information is described in our Privacy Notice, which forms part of these Terms. In short: your files never leave your device, and visits are counted without cookies, with a switch to turn that off.
13. Availability and changes to the Site
We may change, suspend or discontinue any part of the Site at any time, without notice and without liability to you.
14. Governing law and disputes
14.1 These Terms are governed by the laws of the Republic of Turkey, without regard to its conflict-of-law principles, except to the extent mandatory consumer-protection law of your country of residence grants you additional rights that cannot be waived by contract (Section 9).
14.2 Venue: the competent courts of Istanbul, Republic of Turkey.
14.3 Time limit on claims. To the extent permitted by applicable law, any claim arising out of or relating to these Terms or the Site must be filed within one (1) year after the claim arose, or it is permanently barred.
15. Changes to these Terms
We may update these Terms from time to time. Each version has a number and a date at the top. If a change affects using your own files on the Site, you will be asked to accept the new version before you do that again. Your continued use of the Site after a new version is published means you accept it.
16. General
16.1 Entire agreement: these Terms, together with the Privacy Notice, are the entire agreement between you and bitrotlab about the Site.
16.2 Severability: if any provision is held unenforceable, it will be enforced to the maximum extent permissible and the remaining provisions remain in full effect.
16.3 No waiver: failure to enforce any provision is not a waiver of it.
16.4 Language: these Terms are written in English. If a translation is ever provided, the English version prevails.
